Examen de los elementos de superioridad jurisdiccional del Estado sobre la Iglesia contenidos en la Constitución española de 1812, a la luz de los trazos absolutistas que, procedentes del Antiguo Régimen y protegidos por el liberalismo, lograron mantenerse en su articulado, pese a la eliminación de instituciones muy significativas como la Inquisición. Esa pervivencia marca también la historia constitucional posterior hasta nuestros mismos días.

A study of the elements of the State’s jurisdictional superiority over the Church, as contained in the Spanish Constitution of 1812 in the light of vestiges of absolutist thought –which have their origins in the Old Regime- and were kept in place by the Liberal Regime and managed to remain in its articles in spite of the elimination of such significant institutions as the Inquisition. That survival has also marked the subsequent constitutional history up to this day.
