Caso de Derecho marítimo: Naufragio y remoción del buque “Castillo de Salas”. (RI §408599)  


Maritime law: the case of the shipwreck and removal of the “Castillo de Salas” - Ramón Fernández-Guerra

En el presente trabajo se investiga, en base a la inédita documentación judicial del caso, el hundimiento y pérdida del bulk-carrier "Castillo de Salas" junto con su cargamento, en las inmediaciones del puerto de Gijón en enero de 1986. Pese a que este costoso accidente naval produjo un gran impacto social en la zona y estuvo bajo la consideración de autoridades públicas y tribunales de justicia, lo cierto es que apenas ha sido estudiado por la doctrina, por lo que parece de interés realizar, desde una perspectiva de las instituciones del Derecho marítimo, el análisis de los sucesivos elementos jurídicos que confluyeron en el siniestro. De este modo, se atiende a las maniobras de practicaje y fondeo del barco, la varada inicial de la nave, las tentativas de salvamento, el reflotamiento y la larga extracción del pecio, así como la contaminación marítima causada por los carburantes del navío y el carbón de la carga, en relación a la polémica Comisión de Seguimiento (agrupación de hecho creada ad hoc tras el naufragio). En el plano litigioso, se aborda, en vía contencioso-administrativa, el conflicto de competencias que se ocasionó entre la naviera (propiedad de la Administración del estado) y la Administración autonómica asturiana por causa de la dirección de las operaciones de salvamento y anticontaminación. También, se observan las subsiguientes exoneraciones de responsabilidad de los principales protagonistas del episodio, producidas en el ámbito de la jurisdicción penal. Y por último, se finaliza el estudio del caso, en el campo de los seguros marítimos, con el tratamiento de los convenios de indemnización de responsabilidad civil que se acordaron entre aseguradores y perjudicados.

Using unpublished judicial documentation related to the case, this article explores the sinking and loss of the bulk-carrier “Castillo de Salas” and its cargo off the port of Gijón in January 1986. The social impact of this costly naval accident was considerable, as was the scrutiny it received from government and the courts, yet it has been barely studied from a doctrinal perspective. It seems thus opportune to provide an analysis based on maritime law of the various elements that came together in the accident: pilotage and raising of the ship, its initial stranding, salvage attempts, refloating and lengthy retrieval of flotsam, marine pollution caused by the ship’s fuel and coal cargo, and the role of the controversial Enquiry Committee set up after the shipwreck.From the point of view of litigation and the administrative dispute, the following article will analyze the conflict between the government-owned shipping-company and the Asturian regional government over who had proper jurisdiction over salvage and anti-pollution operations. The article will also examine how the principle parties involved were subsequently absolved of criminal liabilities. This article will ultimately look at the case in the light of maritime insurance and civil compensation settlements reached between insurers and injured parties.
