Working time regulation of doctors and nurses who receive, through the residency system, the formal education needed to access the official certificate of specialization in health sciences - Erik Monreal Bringsvaerd

Este estudio versa sobre la dinámica del tiempo de trabajo de los médicos y enfermeros que reciben a través del sistema de residencia la formación reglada y oficial necesaria para acceder al título de especialista en Ciencias de la salud. La Ley 44/2003, de Ordenación de las profesiones sanitarias, confirmó la naturaleza laboral especial de esta relación de trabajo y habilitó al Gobierno para regular su régimen jurídico, en sus vertientes propiamente laboral y formativa. Dicho desarrollo normativo se ha producido finalmente a través del RD 1146/2006, que regula la relación laboral especial de residencia para la formación en Ciencias de la salud, y del RD 183/2008, por el que se determinan y clasifican las especialidades en Ciencias de la salud. El régimen jurídico del tiempo de trabajo del personal residente plasmado en el citado decreto laboral incorpora un enrevesado juego de remisiones expresas e implícitas a la Ley 55/2003, que aprueba el Estatuto marco del personal estatutario de los servicios de salud. Este fenómeno complica el análisis propuesto, que además no puede perder de vista el rol esencial que cumple la negociación colectiva en esta relación laboral de carácter especial, tanto la negociación colectiva propiamente laboral como el remedo de negociación colectiva que se produce en el ámbito de la Función Pública –en general o en el terreno sanitario más en particular-. Perfilando los puntos a tratar en este estudio, el mismo dará cuenta del régimen jurídico de los tres elementos que estructuran la gestión del tiempo de trabajo en cualquier ámbito de actividad, referidos a la problemática de la duración, distribución y cómputo del tiempo de trabajo del personal residente.

This study deals with the dynamics of working time of doctors and nurses who receive, through the residency system, the formal education needed to access the official certificate of specialization in Health Sciences. The Law 44/2003 of Regulation of the health professions, confirmed the labour nature of this particular relationship and enabled the Government to regulate its legal system in both aspects, labour and formative. This statutory development has been finally produced by means of the RD (Royal Decree) 1146/2006, which regulates the special employment relationship of residency for training in Health sciences, and by means of the RD 183/2008, which classifies and determines the different specialities of Health Science. The legal system ruling the working time of this kind of employees, embodied in the said decree (RD 1146/2006), includes a complicated set of explicit and implicit references to the Law 55/2003, which establishes the basic regulation for the statutory Personnel of the Health services. This phenomenon complicates the proposed analysis; in this sense, the reader must bear in mind the essential role of collective bargaining in this special labour relationship, both, proper labour collective bargaining itself, as well as the semblance of collective bargaining that occurs in the field of the Public Service –either in general Public Service or in the Health Public Service in particular-. Outlining the different aspects of this study, the same will consider the legal system of the three elements that structure the management of the working time/hours in any field of activity, which are related to the issues of duration, distribution and calculation of the hours of the resident staff.
