Un estudio sobre el uso del Derecho Comparado por los Tribunales: Ashoka Kumar Thakur V. Union of India & Ors - Sara Pennicino

Este artículo tiene su base en una resolución reciente de la Corte Suprema India, Ashoka Kumar Thakur v. Union of India & Ors, de 10 de marzo de 2008, que representa un caso idóneo para demostrar la importancia de un acercamiento más comprensivo al estudio del uso del Derecho comparado por los Tribunales Supremos y Constitucionales. La primera parte del artículo se dedica a la descripción del caso. La segunda se centra en el análisis del uso del Derecho Comparado, y en los motivos que llevaron al Tribunal indio a citar la jurisprudencia estadounidense sobre las acciones positiva por motivos raciales. Por último, en las conclusiones finales, el artículo incide en cómo un acercamiento más comprensivo al estudio del uso del Derecho comparado favorece un mejor análisis de éste último.

This paper finds its premise in a recent decision of the Indian Supreme Court, Ashoka Kumar Thakur v. Union of India & Ors, delivered on March 10th 2008, which represents an excellent case for proving the importance of a more comprehensive approach to the study of the use of comparative law by Supreme/Constitutional courts. The first part of the paper is devoted to the description of the case. The second part focuses on the analysis of the use of comparative law and on the reasons why the Indian Court decided to cite U.S. case law dealing with race based affirmative action. Finally, in the concluding remarks, the paper underlines how a more comprehensive approach to the study of the use of comparative law favours a better analysis of the latter.
