Sin margen de duda, la regulación de un procedimiento sancionador más garantista y el reconocimiento del derecho a la readmisión obligatoria para el personal laboral fijo al servicio de las Administraciones Públicas constituyen avances considerables para facilitar la aproximación de los regímenes jurídicos que aún mantiene importantes diferencias entre el personal laboral y el funcionario. Sin embargo, la técnica jurídica empleada puede originar problemas aplicativos. Al análisis de este efecto singular del despido se dedican las correspondientes consideraciones.
