The Agreement between the Fernando Poo’s Governor and the king of Bimbia in 1862 - Antonio M. Carrasco González

La ausencia de colonización española en África se debió a la falta de decisión política, y en ningún caso al coste que ello hubiera supuesto. Por eso el Gobernador de la colonia de Fernando Poo, actuó discrecionalmente a falta de normas jurídicas propias. Se continuó así con la tradición del Derecho indiano, acumulando las funciones de Capitán General y Presidente de la Audiencia, aunque tácitamente, pues las funciones gubernativas, legislativas, jurisdiccionales y la posibilidad de negociar con otros pueblos se ejercieron efectivamente, pero sin recibir los títulos correspondientes. El autor analiza esta situación en genera y se extiende después en las posibilidades de negociar con otros pueblos en busca de productos necesarios y mano de obra que escaseaba Fernando Poo, actuando bajo la doble función de otorgar una cierta personalidad internacional tanto a la Colonia española, que no tenía ni tuvo nunca, y de reconocerla a los reyezuelos indígenas de África.

The absence of Spanish colonization in Africa was due to the lack of political drive, and in no case to the cost that the process of colonization would have supposed. For that reason, the Governor of the colony of Fernando Poo acted discretionarily for want of its own legal norms. He was thus aligned within the tradition of the Indian Law, accumulating the functions of Commander in chief and President of the Audience. He did so tacitly, although, because the gubernative, legislative, and jurisdictional functions were exerted indeed, as well as the possibility of negotiating with other towns, but without receiving the corresponding titles. This situation is summarily analyzed by the author, who later abounds in the possibilities of negotiating with other towns in search of products and work force, that was scarce at Fernando Poo. By doing so, the Governor acted under a double function: to grant a certain international personality to the Spanish Colony, that it never had, and to recognize that same personality to the indigenous little kings of Africa.
