La función de la pericia psicológica en el ámbito penal ha experimentado una transformación. En sus orígenes se solicitaba a los peritos psiquiatras y psicólogos que se pronunciaran sobre estado mental de un sujeto en el momento de cometer un hecho delictuoso, es decir, la función de la pericia psicológica y psiquiátrica forense giraba en torno al concepto de imputabilidad. Sin embargo, en los últimos años una preocupante tendencia parece instalarse en el ámbito del derecho penal. Así, en la actualidad el discurso jurídico interpela al perito psicólogo para que mediante la realización de un estudio completo y profundo de la personalidad del sujeto, dictamine sobre si existe en el peritado un perfil de personalidad compatible con el hecho que se le imputa. Sin dudas, la búsqueda de perfiles de criminales ha caracterizado al positivismo criminológico dando origen al derecho penal autor. En la actualidad asistimos a lo que se ha denominado el resurgimiento de un nuevo derecho penal de autor, basado en la búsqueda de signos y síntomas psicológicos que revelen el estado del autor y del cual se desprende el hecho delictuoso que se le imputa. Es en este punto donde las pericias psicológicas en materia penal se transforman en un discurso del poder formando, así, parte del engranaje de la maquinaria punitiva.
The role of psychological expertise in criminal law has undergone a transformation. However, in recent years a disturbing trend seems to settle in the area of criminal law. Undoubtedly, the pursuit of criminal profiling has characterized the positivism criminological giving rise to criminal law author. At present witnessing what has been called the resurgence of a new criminal law copyright, based on the search for signs and symptoms that reveal the psychological state of the author and which shows the offense with which he is charged. This is where the psychological expertise in criminal matters are transformed into a discourse of power forming thus part of the machinery of the punitive machinery.
