Some considerations around the regulation of the youthful gangs in Statutory Law 8 of 2006 - Lina Mariola Díaz Cortés

A raíz de las numerosas reformas de la LORPM, se plantea la desnaturalización del sistema de responsabilidad penal juvenil presidido por el interés superior del niño, y su desplazamiento por la introducción del modelo de seguridad ciudadana. Pese a que las estadísticas oficiales revelan que no ha existido un aumento de la delincuencia juvenil, la última reforma establece como la sola pertenencia del menor a una banda, organización o asociación ilícita, de carácter incluso temporal, conlleva a la aplicación de la medida de internamiento con independencia del delito que se cometa. No se puede vincular a toda agrupación juvenil con actividades delictivas, sobre todo, cuando la agrupación del menor en bandas es propia de su proceso de socialización. Por lo anterior, estereotipar a las bandas juveniles como delictivas y vincularlas a la inmigración, supone estigmatizar a toda agrupación juvenil y a un colectivo presente en la realidad española.

As a result of the many reforms of the LORPM, now it is spoken about the denaturation of the criminal minors system, presided by the best interests of the child. That is been replaced by the introduction of the model of citizen security. Although the official statistics reveal that an increase of the youthful delinquency has not existed, the last reform establishes that the single membership of the minor to a gang, organization or illicit association, of even a temporary character, entails the application of the confinement sanction independently of the crime that is committed. It is not possible to link all youthful grouping with criminal activities, mainly, when the grouping of the minor in gangs is natural of their socialization process. For this reason, stereotype the youthful gangs as criminals and link them to immigration, supposes to stereotype all youthful grouping and a collective that is present in the spanish reality.
