The Federalism Reform in Germany. (RI §400543)

The article analyzes the federal structure of the Germany after the constitutional amendment of 2006. More specifically, the author describes the distribution of legislative power between Laender and Bund, and the newly introduced principle according to which the law of the Laender can sometimes prevail over Federal law. He also underlines the relevance of the constitutional reform from a European perspective. In conclusion, the article illustrates the differences that exist among federal forms of government, thus demonstrating the difficulty in classifying them according to traditional criterion that proves to be quite rigid.

El artículo analiza la estructura federal de la Alemania tras la reforma constitucional de 2006. En particular, el autor describe la distribución del poder legislativo entre los Länder y el Estado central, y el nuevo principio introducido según el cual la ley de los Länder puede prevalecer en ocasiones sobre la ley federal. El autor también subraya la importancia de la reforma constitucional desde una perspectiva europea. En conclusión, el artículo muestra las diferencias que existen entre formas federales de gobierno, demostrando así la dificultad en clasificarlas según el criterio tradicional que demuestra ser absolutamente rígido.
