Effects of termination of the contract by the will of the professional sporstman: about the validity of extinguishment clauses. Commentary to sentence of Tribunal Superior de Justicia del País Vasco of 17th of October 2006 - Ángel Luis de Val Tena

Cuando, por voluntad propia, el deportista profesional extingue el contrato de trabajo antes de su finalización, debe abonar al club la indemnización pactada o, en ausencia de pacto, la indemnización que fije la Jurisdicción Social, siendo responsable subsidiario el club que contrate al deportista durante el año siguiente a la extinción del contrato.

When the professional sportsman, by his will, terminates the contratc of employment before the end of its duration, he must pay to the club the agreed indemnification or, in absence of agreement, the indemnification fixed by Labour Jurisdiction, being subsidiarily liable the club that engages the professional sportman during the following year to the extinguishment of the contract.
