El presente trabajo tiene por objeto analizar las posibles conformaciones de la jurisdicción militar, abogando por la estructuración y consagración de la misma como jurisdicción especial. Desde esta perspectiva, se evidencia -y en este sentido se denuncia- que su existencia supone manifiesta vulneración de los principios de unidad y exclusividad jurisdiccional, así como del derecho fundamental al juez ordinario predeterminado por la ley; todo ello en íntima conexión con la cuestionable independencia e imparcialidad de los jueces militares.

The target of the present issue is to analize the possible conformations of the military jurisdiction, pelading for its structure and its establishment as special jurisdiction From this point of view, it is obvious -and so it is condemned in this way- that still being present involves a flagrant infringement of the unity and the jurisdictional exclusivity principles, as well as the basic right to the ordinary judge predetermined by the law; what in itself it is in close connection with the doubtful independence and impartiality of the military judges.
