The heavy transport of species largitionales under postclassical roman law: the cursus clabularius and the bastaga - Belén Malavé Osuna

El presente trabajo tiene por objeto indagar en la regulación jurídica del transporte pesado de ciertas especies fiscales, destinadas a engrosar una de las secciones del tesoro central, las Sagradas Liberalidades (SL), en época postclásica. En efecto, las fuentes avalan la existencia de un entramado viario idóneo para el desplazamiento terrestre de tales especies, mediante el sistema del cursus clabularius; una subespecie del genérico cursus publicus. Junto a esta vasta red de comunicaciones y transportes de carácter oficial -no público- convivió la llamada bastaga, de incierta naturaleza, cuyas particularidades tratamos de desentrañar en la contribución. Desde el punto de vista de la organización sistemática, hemos creído oportuno comentar en primer lugar todo lo relativo a los tituli largitionales o especies fiscales, con objeto de conocer los productos o mercancías desplazadas, para pasar después a las fuentes que reglamentan su transporte, avanzando ciertas ideas que creemos consolidadas para continuar investigando acerca del asunto. Finalmente, el estudio se cierra con algunas notas conclusivas, seguidas de un elenco de referencias bibliográficas.

The aim of this paper is to investigate the legal regulation of the heavy transport of certain fiscal species, destined to swell one of the sections of the central treasury, the Sacred Liberalities (SL), in the post-classical period. In fact, the sources support the existence of a road network suitable for the overland movement of such species, by means of the system of the cursus clabularius; a subspecies of the generic cursus publicus. Alongside this vast network of official - not public - communications and transport, there was the so-called bastaga, of an uncertain nature, the particularities of which we will try to unravel in this contribution. From the point of view of the systematic organisation, we have thought it appropriate to comment firstly on everything related to the tituli largitionales or fiscal species, in order to know the products or goods moved, and then move on to the sources that regulate their transport, advancing certain ideas that we believe are consolidated in order to continue researching the subject. Finally, the study closes with some concluding notes, followed by a list of bibliographical references.
