En el sistema jurídico multinivel de garantía de los derechos fundamentales adquiere un papel central el principio de indivisibilidad e interdependencia entre todos los derechos fundamentales. Este principio enlaza con la idea-fuerza de que los derechos fundamentales presentan la unidad propia de su principio articular, que no es otro que la dignidad humana. En los sistemas jurídicos actuales y en el pensamiento contemporáneo prevalece la idea de la indivisibilidad de los derechos fundamentales. Este principio de indivisibilidad presupone que los derechos fundamentales forman un bloque unitario y no pueden ser situados en una estricta relación jerárquica. Tales derechos se presuponen y necesitan mutualmente en orden a garantizar su plena efectividad jurídica social. Dicha indivisibilidad e interdependencia se debe vincular con la problemática de la efectividad de los derechos fundamentales y no sólo en el sentido de eficacia jurídica en orden a la predisposición de mecanismos apropiados de tutela judicial efectiva, sino también, en ligazón inmanente con la misma, con la efectividad práctica de tales derechos (eficacia jurídica en la realidad; en el mundo de la vida donde el Derecho se hace realmente “vivo”). Por otra parte, y en este marco analítico, es importante reconsiderar el llamado principio de no regresión o irregresividad del nivel alcanzado en la garantía de los derechos fundamentales.

On the other hand, and in this analytical framework, it is important to reconsider the so-called principle of non-regression or irregresividad of the level attained in the guarantee of fundamental rights.
