En el presente trabajo se analiza la evolución histórica de la figura del contrato administrativo, la misma nos permite plantear los motivos que hacen que surja la figura, y reflexionar acerca de su oportunidad en el momento actual. Actualmente las exigencias que provienen de instancias comunitarias, pueden aprovecharse para potenciar la figura del contrato administrativo, de esta manera se tendrá un instrumento jurídico más eficiente. Es necesario, ante la nueva transposición que está pendiente de las Directivas de contratos, posicionarse dogmáticamente sobre los perfiles institucionales que debe tener el contrato administrativo.

In the present study the historical evolution of the figure of the contract is analyzed, it allows us to consider the reasons that give rise to the figure, and think about your opportunity at the present time. Currently the demands that come from community agencies, can be used to enhance the figure of the contract, thus a more efficient legal instrument will. It is necessary, before the new transposition of the Directives is pending contracts, dogmatic position on institutional profiles should have the contract.
