La ley de Derecho Civil de Galicia contiene la regulación legal del régimen económico matrimonial. Consta de tres capítulos, el primero de ellos dedicado a las disposiciones generales, el segundo a las capitulaciones matrimoniales, y un tercer y último capítulo que regula las donaciones por razón de matrimonio. En el presente trabajo se analiza cada uno de ellos por separado para un mejor análisis de la regulación contenida en la ley 2/2006, comenzando por el artículo 171: “El régimen económico matrimonial será el convenido por los cónyuges en capitulaciones matrimoniales. En defecto de convenio o ineficacia del mismo, el régimen será la sociedad de gananciales”. En otros derechos forales el sistema elegido ha sido el de separación de bienes, como sucede en Cataluña y Baleares, algo que parece más lógico a la vista de los problemas derivados de la partición y disolución de la sociedad familiar en caso de optar por una sociedad de gananciales. La comisión superior de derecho civil de Galicia defiende la modificación de la ley gallega para optar por el régimen de separación de bienes, lo que refrenda la necesidad de este cambio legal.
The Galician civil law contains the legal regulation of matrimonial property. It consists of three chapters, the first of which is dedicated to the general provisions, the second to the marriage, and a third and final chapter governing gifts by reason of marriage. This paper examines each of them separately for a better analysis of the regulation contained in the law 2 / 2006, starting with Article 171: "The matrimonial property regime will be agreed by the spouses in a marriage contract. Failing agreement or ineffectiveness, the system shall be the conjugal partnership”. In other foral legislation the system chosen was the separate property, as in Catalonia and the Balearic Islands, which seems more logical in view of the problems arising from the partition and dissolution of the family firm should opt for a society of property. The High Commission of Galician civil law defends Galician law change to choose the regime of separate property, which endorses the need for this legal change.
