En la STS, de 7 marzo de 2012, se plantea de nuevo la posibilidad y condiciones para el reconocimiento de una pensión de viudedad, cuando en el momento del hecho causante existían cuotas debidas sin prescribir en el Régimen Especial de Trabajadores Autónomos, pero prescritas en el momento de solicitar la pensión. La sentencia tiene la oportunidad, mediante la resolución del Recurso de casación para la unificación de doctrina, de completar, y quizás cerrar, la doctrina acerca de la prescripción sobrevenida de las cuotas debidas en el RETA en el momento del hecho causante, al reafirmarse en la doctrina que establece que la prescripción posterior al hecho causante no equivale al cumplimiento del requisito de estar “al corriente” ni subsana el incumplimiento verificado en tal fecha; y establecer que una vez cursada la solicitud de la pensión de viudedad, la entidad gestora debe invitar al pago de las cuotas pendientes en la fecha del hecho causante, incluso de las cuotas prescritas en el momento de la solicitud.

In the STS, on March, 7th 2012, it again raises the possibility and conditions for recognition of a widowhood's pension, when at the time of the event had not prescribed the fees due under the Special Scheme for Self-Employed, but prescribed in the moment of applying for a pension. The judgment has the opportunity of to close the supervening prescription doctrine of fees due under the RETA at the time of the triggering event, by resolution of Appeals for the unification of doctrine, to reassert the doctrine that the prescription after the events is not equivalent to the requirement of being “up to date” to remedy the breach verified in that date, and establish that once completed the application for widow's pension, the managing body should to invite to the pay of the outstanding assessments on the date of the triggering event, including the fees prescribed in the time of application.
