Royal Decree 1331/2006, of 17 november, governing the special employment relationship of lawyers rendering services in law firms - Ignacio García-Perrote Escartín

El presente artículo analiza el reciente Real Decreto 1331/2006, de 17 de noviembre. El trabajo se centra en el ámbito de aplicación y en las fuentes de regulación, con especial atención a los convenios colectivos. Se analizan también los derechos y obligaciones de las partes, la necesidad de formalizar por escrito los contratos de trabajo y de que en ellos consten determinadas "especificaciones". Como regla general el abogado presta sus servicios en régimen de dedicación exclusiva. También es posible acordar pactos de permanencia y de no competencia postcontractual. La jornada máxima es la legalmente establecida en cómputo anual y se puede distribuir de forma irregular. Se examinan, finalmente: el derecho y el deber de obtener formación; las causas de suspensión y extinción; el régimen disciplinario y la competencia del orden jurisdiccional social.

This Note refers to the content of the recently passed Royal Decree 1331/2006, of 17 November. This Note focuses particularly on the scope of application of the Royal Decree and regulations, with special regard to the collective bargaining agreements. The Note also analyses the rights and duties of the parties, the need to execute employment agreements in writing and the provision of certain "specifications". The general rule is that the lawyer provides services to the law firm on an exclusive basis. The Royal Decree also sets forth the possibility of establishing continuity of employment, or post-contractual non competition clauses. Working time shall be established on a yearly basis and the maximum daily working time can be distributed on an irregular basis. Finally, the following is also analysed: the right and duty to train employees; suspension or termination causes; disciplinary sanctions regime and; the competence of Labour courts.
