El presente trabajo ofrece una propuesta asociada con la identificación de las relaciones entre los sistemas normativos indígenas y estatales en una vertiente de confrontación que ocurre dentro de un escenario asociado al reconocimiento de sus derechos, valores e intereses esenciales, regenerando los planteamientos asociados a las formas convencionales de creación normativa. Las tensiones producto de esta sinergia se dan en virtud de las distintas concepciones de la realidad y los aspectos culturales asociados a la conformación de los grupos autóctonos que identifican para sí distintos contenidos de sus derechos fundamentales más allá de la homologación universal que intenta realizar el Estado actual.

The present work offers a proposal associated with the identification of the relationships between indigenous and state regulatory systems in an aspect of confrontation that occurs within a scenario associated with the recognition of their rights, values and essential interests, which regenerates the approaches associated with conventional forms of normative creation. The tensions resulting from this synergy occur due to the different conceptions of reality and the cultural aspects associated with the formation of indigenous groups that identify for themselves different contents of their fundamental rights beyond the universal homologation that the current State tries to achieve.
