Constitutional protection of the environment following the reform of articles 9 and 41 of the italian constitution - Bruna Pellicanò

La presente contribución ofrece un analisis jurídico sobre la protección constitucional del medioambiente en relacion con la reciente reforma de los artículos 9 y 41 de la Constitución italiana, modificados por la Ley Constitucional de 11 de febrero de 2022, n. 1. El legislador, mediante una narrativa sin precedentes,ha pretendido la inclusión, de manera explícita de acciiones para la defensa del medio ambiente, de la biodiversidad y de los ecosistemas. Destaca el interés en la protección de las generaciones futuras y animales en el catálogo de los principios fundamentales de la Constitución .Finalmente, se estudia la importancia del tema medioambiental respecto a la iniciativa económica prevista por el art. 41 de la Constitución.

This paper aims to analyse the constitutional protection of the environment in the light of the recent reform of Articles 9 and 41 of the Constitution, as amended by Constitutional Law no. 1 of 11 February 2022. This reform has certainly had the merit of including, in an explicit form, the protection of the environment, biodiversity and ecosystems, also in the interest of future generations, as well as the protection of animals within the catalogue of fundamental principles of the Italian Constitution; as well as emphasising the importance of the environmental issue with respect to economic initiative as provided for in Article 41 of the Constitution.
