Intersection of reliable AI with Labor Law. A legal and technical study from a tripartite taxonomy - Adrián Arnaiz Rodríguez y Julio Losada Carreño

Este trabajo explora la intersección entre la Inteligencia Artificial (IA) y el derecho del trabajo, centrándose en el impacto de las tecnologías de IA en el ámbito laboral desde perspectivas técnicas y jurídicas. Para ello, se utiliza una taxonomía tripartita que diferencia entre las etapas de preimplantación y postimplantación que componen el ciclo de vida de un sistema de IA, los elementos que conforman dichos sistemas y los requisitos exigidos para que una IA sea calificada como fiable. Este estudio destaca las principales obligaciones jurídicas y principios éticos establecidos por el High-Level Expert Group on AI (HLEG) y el Reglamento de IA, que determinan los requisitos que una IA debe cumplir para ser considerada fiable, tales como la supervisión humana, solidez técnica, gestión de la privacidad y los datos, transparencia, diversidad, no discriminación y equidad, bienestar social y ambiental, y rendición de cuentas. Además, se examina cómo estos requisitos intersecan con el derecho del trabajo(1). Por último, se acompaña este trabajo de un ejemplo y un cuadro de equivalencias que previsiblemente facilitarán el entendimiento de los conceptos más complejos.

This paper explores the intersection between Artificial Intelligence (AI) and labor law, focusing on the impact of AI technologies in the workplace from technical and legal perspectives. To do so, it uses a tripartite taxonomy that differentiates between the pre-implementation and post-implementation stages that make up the life cycle of an AI system, the elements that make up such systems and the requirements demanded for an AI to be qualified as reliable. This study highlights the main legal obligations and ethical principles established by the High-Level Expert Group on AI (HLEG) and the AI Regulation, which determine the requirements that an AI must meet to be considered trustworthy, such as human oversight, technical soundness, privacy and data management, transparency, diversity, non-discrimination and fairness, social and environmental well-being, and accountability. In addition, it examines how these requirements intersect with labor law. Finally, this paper is accompanied by an example and a table of equivalencies that should facilitate the understanding of the more complex concepts.
