A review of the limits to the exercise of the freedom of assembly: three recent cases - Miguel Ángel Sevilla Duro

Este trabajo analiza las limitaciones al ejercicio del derecho de reunión en España en tres contextos recientes particularmente conflictivos: las manifestaciones durante la pandemia de COVID-19, las protestas frente a la sede del PSOE en Ferraz a finales de 2023 y las "tractoradas" y protestas agrícolas de comienzos de 2024. Tras examinar el contenido del derecho de reunión y sus límites constitucionales en abstracto, el trabajo evalúa la adecuación de las limitaciones y restricciones impuestas en los tres supuestos citados a la luz de la jurisprudencia nacional y del Tribunal Europeo de Derechos Humanos. Con ello se aspira a reflexionar sobre el equilibrio constitucionalmente adecuado entre este derecho fundamental y la necesidad de mantener el orden público en toda sociedad democrática.

This paper examines the restrictions on the freedom of assembly in Spain in three particularly contentious recent contexts: the demonstrations during the SARS-CoV-2 pandemic, the protests in front of the PSOE headquarters at the end of 2023 and the agricultural protests at the beginning of 2024. After examining the general content of the right to assembly and its constitutional limits, the paper assesses the adequacy of the limitations and restrictions imposed in the three cases mentioned in light of national and European Court of Human Rights case law. The aim of this analysis is to reflect on the constitutionally appropriate balance between this fundamental right and the need to maintain public order in any democratic society.
