La protección de los animales durante el transporte está regulada a nivel comunitario desde 1977. La normativa actualmente vigente a nivel nacional es el Real Decreto 990/2022, de 29 de noviembre, sobre normas de sanidad y protección de animal durante el transporte. Este real decreto, que forma parte del paquete legislativo de acompañamiento del Plan Estratégico de la Política Agrícola Común, introduce mejoras para la realización de los controles oficiales, amplia los requisitos para los operadores de puertos y aeropuertos y para la formación del personal, así como para los transportistas, todo ello a partir de la experiencia adquirida en la implementación de la normativa anterior y basándose en el nuevo marco comunitario para los controles oficiales. En el marco de la Unión Europea, el Reglamento (CE) nº 1/2005 del Consejo de 22 de diciembre de 2004 relativo a la protección de los animales durante el transporte ha sido sometido a un proceso de revisión en el contexto de la Estrategia de la Granja a la Mesa. Como resultado de este procedimiento de revisión, la Comisión Europea ha presentado en diciembre de 2023 una nueva propuesta de Reglamento comunitario con el objetivo de contribuir a una producción agrícola y alimentaria sostenible, garantizando un mayor nivel de bienestar animal y evitando distorsiones en el mercado interior, contribuyendo así a un cambio hacia un sistema alimentario sostenible desde el punto de vista económico, medioambiental y social.

The protection of animals during transport has been regulated at Community level by the European Union since 1977. The legislation currently in force at national level is Royal Decree 990/2022 of 29 November on animal health and protection issues during transport. This Royal Decree, which forms part of the legislative package accompanying the Strategic Plan for the Common Agricultural Policy, introduces improvements in the performance of official controls, broadening the requirements for port and airport operators and for the training of staff, as well as for transporters, based on the experience gained in implementing the previous legislation and building on the new Community framework for official controls. Within the framework of the current European Union, the Council Regulation (EC) nº 1/2005 of 22 December 2004 on the protection of animals during transport has been subject to a review process in the context of the Farm to Fork (F2F) Strategy. As a result of this procedure of review, the European Commission has presented in December 2023 a new proposal that seeks to contribute to sustainable agricultural and food production by ensuring a higher level of animal welfare, and avoiding distortions on the internal market, thereby contributing to a shift towards an economically, environmentally, and socially sustainable food system.
