Motiva estas líneas la consideración de una significativa sentencia “Rueda c. Arzobispado de Salta”(2). En una no muy extensa pero sustancial decisión, la Corte ha tenido ocasión de expedirse -reafirmando propia doctrina-, acerca de la autonomía de jurisdicción entre las esferas estatal y religiosa, que constituye un pilar fundamental de la garantía de libertad religiosa contenida en la Ley Fundamental. Asimismo, ha sostenido la validez y jerarquía superior a las leyes del Acuerdo de 1966 entre Argentina y Santa Sede. Por último, ha dejado sentada la inexistencia de un derecho civil a la disidencia entre los fieles y sus comunidades religiosas de pertenencia.
These lines of thought are motivated by the consideration of the decision of the Supreme Court of Justice from Argentina, in the case “Rueda, A. c. Arzobispado de Salta s/acción de hábeas data”. In a non-extensive but substantial ruling, the Court has had the occasion to dispatch -affirming its own previous doctrine, about the autonomy of jurisdiction between the government and religion beliefs, that constitutes a fundamental basement for religious freedom, such it is presented in the Fundamental Law. In addition, it has affirmed the validity of the Agreement from 1966 between Argentina and the Holy See. Finally, it has declared that there is not such thing as a right to dissidence between the members of the religious communities and them.
