hace tiempo que las “amenazas híbridas” copan la preocupación de los principales actores que intervienen en el marco de la Seguridad Nacional de los Estados y de otros organismos supraestatales. Frente a los tradicionales mecanismos de desestabilización han surgido otros “más sigilosos” pero igual o, incluso, más letales. Entre sus principales objetivos se encuentran los mercados, el espacio electoral, las instituciones democráticas, la salud pública, la convivencia pacífica, y un largo etcétera. En este trabajo pretendemos dar cuenta, por un lado, de la importancia que el fenómeno de la desinformación tiene para los Estados, para la propia Unión Europea y otros organismos internacionales. Y, a partir de ahí, valorar si en este caso el Derecho penal debiera ofrecer algún tipo de respuesta. De otro lado, se hace especial hincapié en el tratamiento diferenciado que debe darse a las llamadas fake news.

Hybrid threats have been the concern of the main actors involved in the National Security of States and other supra-state organizations for some time. Faced with the traditional mechanisms of destabilization, other "more stealthy" but equally or even more lethal have emerged. Among its main objectives are markets, electoral space, democratic institutions, public health, peaceful coexistence, and a long etcetera. In this work we intend to give an account, on the one hand, of the importance that the phenomenon of disinformation has for the States, for the European Union itself and other international organizations. And, from there, assess whether in this case criminal law should offer some kind of response. On the other hand, special emphasis is placed on the differentiated treatment that should be given to the so-called fake news.
