Contributions of constitutional jurisprudence to the field of disability. Special reference to SSTC 3/2018 and 52/2022 - Elena García-Cuevas Roque

El concepto de discapacidad ha ido evolucionando con el paso del tiempo, introduciéndose en el discurso de los derechos humanos. La labor de interpretación de los tribunales en el terreno de los derechos fundamentales, tomando como base el espíritu de la Convención Internacional sobre los Derechos de las Personas con Discapacidad, ha contribuido a cambiar el enfoque tradicional de este concepto. En este contexto, nuestro Tribunal Constitucional ha analizado el alcance del art. 49 CE con una gran delicadeza desde esta perspectiva de derechos humanos, conectándolo con otros preceptos de protección reforzada. En líneas generales, y a través de su jurisprudencia y doctrina, el Tribunal Constitucional corrobora la conexión del art. 49 CE con el mandato de tratamiento igual y no discriminatorio de las personas con discapacidad, lo que podrá apreciarse en el recorrido por sus principales pronunciamientos.

The concept of disability has evolved over time, entering the discourse of human rights. The interpretative work of the courts in the field of fundamental rights, based on the spirit of the Convention on the Rights of Persons with Disabilities, has contributed to changing the traditional approach to this concept. In this context, the Spanish Constitutional Court has analyzed the scope of art. 49 CE with great delicacy from this human rights perspective, connecting it with other precepts of reinforced protection. In general terms, and through its jurisprudence and doctrine, the Constitutional Court corroborates the connection of art. 49 CE with the mandate of equal and non-discriminatory treatment of people with disabilities, which can be seen in a review of its main pronouncements.
