Impact of the tax residence rule in the field of personal taxation of teleworkers - Montserrat Casanellas Chuecos

El presente artículo tiene por objeto de estudio el análisis de los criterios de sujeción a las normas tributarias y su impacto en la tributación de las retribuciones recibidas por el teletrabajador, dentro y fuera de territorio español. Este análisis se realiza tomando en especial consideración el contenido de los convenios de doble imposición internacional firmados por el Estado español, así como los recientes criterios administrativos y jurisprudenciales sobre la materia.

La residencia fiscal como criterio de sujeción de las rentas obtenidas mediante la realización de teletrabajo en un Estado. 2. La territorialidad como criterio de sujeción de las rentas obtenidas por el trabajo presencial efectivamente realizado en un Estado distinto al de la residencia.- IV. TRIBUTACIÓN DE LOS RENDIMIENTOS OBTENIDOS POR EL TELETRABAJADOR EN EL ÁMBITO DE SU IMPOSICIÓN PERSONAL. 1. Tributación del teletrabajador residente en territorio español. 1.1. Determinación de los rendimientos netos del trabajo personal sujetos a tributación en el IRPF del teletrabajador. 1.1.1. Entrega de equipos, medios y herramientas para el desarrollo del trabajo a distancia. 1.1.2. Compensación de gastos ocasionados por el teletrabajo. 1.1.3. Gastos deducibles para la determinación de los rendimientos netos del trabajo personal sujetos a tributación. 1.2. Exención por rendimientos del trabajo percibidos por trabajos efectivamente realizados en el extranjero (art. 7.p LIRPF). 1.3. Deducción por doble imposición internacional respecto a los rendimientos del trabajo obtenidos por trabajos realizados en el extranjero (art. 80 LIRPF). 2. Tributación del teletrabajador no residente en territorio español respecto a las rentas vinculadas a tareas efectivamente realizadas en España.- V. REFLEXIONES FINALES.- VI. BIBLIOGRAFÍA.

This article analyzes the tax rules subjection and their impact on the taxation of the remuneration received by the teleworker, inside and outside Spanish territory. This analysis is carried out taking into special consideration the content of the international double taxation agreements signed by the Spanish State, as well as the recent administrative and jurisprudential criteria on the matter.

Residence as a rule for the taxation of income obtained by teleworking in a State. 2. Territoriality as a rule for the taxation of income obtained by face-to-face work effectively carried out in a State other than the State of residence.- IV. TAXATION OF THE INCOME OBTAINED BY THE TELEWORKER IN THE FIELD OF HIS PERSONAL TAXATION. 1. Taxation of the teleworker resident in Spanish territory. 1.1. Determination of the net yields of the employment subject to taxation in the IRPF of the teleworker. 1.1.1. Delivery of equipment, means and tools for the development of the work at a distance. 1.1.2. Compensation of expenses caused by the teleworking. 1.1.3. Deductible expenses for the determination of the net yields of the employment subject to taxation. 1.2. Exemption for employment income received for work effectively carried out abroad (art. 7.p LIRPF). 1.3. Deduction for international double taxation with respect to employment income for work carried out abroad (art. 80 LIRPF). 2.
