The impact of new technologies on the concept of strike-breaking - María Gorrochategui Polo

En el marco de las relaciones colectivas de trabajo, la obsolescencia del régimen jurídico del derecho fundamental a la huelga no ha impedido que la incidencia de las nuevas tecnologías haya suscitado nuevas interrogantes, como la posibilidad de que la sustitución de trabajadores huelguistas se produzca a través de medios técnicos o tecnológicos. El presente trabajo parte del análisis del desarrollo efectuado por la doctrina constitucional sobre el alcance y el contenido de las formas clásicas de esquirolaje, hasta el reconocimiento más reciente del denominado esquirolaje tecnológico. Posteriormente, se abordará el debate jurisprudencial que ha existido en torno a esta figura, hasta que la Sentencia 17/2017 del Tribunal Constitucional puso fin al vaivén jurisprudencial, avalando la interpretación más restrictiva de derechos fundamentales y menos acorde con el alcance de las nuevas tecnologías en el marco actual de las relaciones laborales. Ello ha dado lugar a un importante retroceso en la protección del derecho de huelga de los trabajadores al permitirse recurrir a la ventaja tecnológica como medio empresarial de desactivación de los medios de protesta de las personas trabajadoras.

In the framework of collective labour relations, the obsolescence of the current legal framework of the fundamental right to strike has not prevented the impact of new technologies from raising new questions, such as the possibility of the substitution of striking workers by technical or technological means. This paper starts by analysing the development of constitutional doctrine on the scope and content of the classic forms of strikebreaking, up to the most recent recognition of the so-called technological strikebreaking. Subsequently, it will address the jurisprudential debate that has existed around this figure, until Decision 17/2017 of the Constitutional Court, which put an end to this jurisprudential back-and-forth, endorsing the most restrictive interpretation of fundamental rights and the less adequate with the scope of new technologies in the current framework of labour relations. This has led to a major setback in the protection of workers' right to strike by allowing the use of technological advantage as a corporate means to disable this form of workers’ protest.
