En este artículo abordaremos la modificación llevada a cabo por la Ley 17/2021 y para ello, en primer lugar, analizaremos de forma sucinta sus antecedentes normativos más directos y el núcleo principal de la reforma (a saber, el artículo 333 bis del Código Civil). Después, estudiaremos la afección de la reforma en sede sucesoria y que se reduce a la incorporación del nuevo artículo 914 bis del Código Civil; precepto que iremos desgranando para conocer con mayor detalle la amplitud de la norma, así como sus carencias principales. Posteriormente también se incluirá un apartado de derecho comparado, en el que se examinará el modelo norteamericano que, sin duda, puede aportar valiosos criterios a nuestra materia objeto de estudio. Y finalmente se contemplarán unas breves conclusiones finales; conclusiones que bien se podrían resumir en celebrar la reforma, a pesar de los muchos flecos que puedan haber quedado sueltos.

In this article we will deal with the amendment carried out by Law 17/2021 and for this purpose, we will first analyze succinctly its most direct regulatory background and the main core of the reform (namely, article 333 bis of the Spanish Civil Code). Then, we will study the effect of the reform on inheritance, which is reduced to the incorporation of the new article 914 bis of the Civil Code; a precept that we will go through in order to know in greater detail the scope of the rule, as well as its main shortcomings. Subsequently, a section on comparative law will also be included, in which the North American model, which can undoubtedly contribute valuable criteria to our subject of study, will be examined. And finally, some brief final conclusions will be contemplated; conclusions that could well be summarized in celebrating the reform, despite the many loose ends that may have been left untied.
