The causes of the temporary contract due to production circumstances and the discontinuous fixed contract: problems of legal certainty - Erik Monreal Bringsvaerd

La nueva regulación del contrato temporal por circunstancias de la producción está fundamentada en complejas causas justificativas, de difícil interpretación, que parecen apuntar a nuevas funcionalidades del contrato enfocadas a la satisfacción de necesidades internas de la empresa. Y con el contrato fijo discontinuo sucede lo mismo, pues desde ahora hay que hablar de un nuevo contrato fijo discontinuo intermitente, que no está sujeto a patrones de temporada, con margen empresarial para determinar la intermitencia. Hay también un nuevo contrato temporal, cuya causa justificativa es terriblemente confusa, que, a la postre, puede solaparse con el contrato fijo discontinuo durante un máximo de 90 días al año. Los interrogantes que abre la nueva regulación de ambos contratos son muchos e importantes, y a los Tribunales del Orden social les corresponde la última palabra.

I. INTRODUCCIÓN.- II. LAS CAUSAS JUSTIFICATIVAS DEL CONTRATO TEMPORAL POR CIRCUNSTANCIAS DE LA PRODUCCIÓN. 2.1. Contrato temporal -largo- por circunstancias de la producción generadas por incrementos ocasionales e imprevisibles de la actividad de la empresa. 2.2. Contrato temporal -largo- por circunstancias de la producción generadas por oscilaciones de la actividad de la empresa. 2.3. Contrato temporal -corto- por circunstancias de la producción ocasionales y previsibles. 2.4. La prohibición de utilizar el contrato temporal por circunstancias de la producción en el marco de contratas y concesiones administrativas.- III. LA POTENCIACIÓN DEL CONTRATO FIJO DISCONTINUO. 3.1. La ampliación del ámbito objetivo del contrato fijo discontinuo. 3.2. Trabajo fijo discontinuo tradicional. 3.3. Trabajo fijo periódico de fechas ciertas, trabajo fijo discontinuo intermitente y trabajo a tiempo parcial, vertical y en cómputo anual: Problemas de deslinde.- IV. CONTRATO TEMPORAL POR CIRCUNSTANCIAS DE LA PRODUCCIÓN, CONTRATO FIJO DISCONTINUO Y NEGOCIACIÓN COLECTIVA: PEONADAS MÍNIMAS Y PORCENTAJES MÁXIMOS DE TEMPORALIDAD.- V. CONCLUSIONES Y PROPUESTAS.

The new regulation of the temporary contract due to production circumstances is based on complex justifying causes, difficult to interpret, which seem to point to new functionalities of the contract focused on satisfying the internal needs of the company. And with the discontinuous fixed contract the same thing happens, because from now on we must talk about new intermittent discontinuous contract, which is not subject to seasonal patterns, with business margin to determine the intermittence. There is also a new temporary contract, whose justification is terribly confusing, which, in the end, may overlap with the discontinuous permanent contract for a maximum of 90 days a year. The questions that arise with the new regulation of both contracts are many and important, and the Courts of Social Order have the last word.

TEMPORARY CONTRACT DUE TO PRODUCTION CIRCUMSTANCES, DISCONTINUOUS FIXED CONTRACT AND COLLECTIVE BARGAINING: MINIMUM PAWNEDS AND MAXIMUM TEMPORARY PERCENTAGES.- V. CONCLUSIONS AND PROPOSALS.
