Efectos de los Derechos fundamentales en relaciones entre particulares. Especial referencia a la tipología de casos en la state action de los Estados Unidos y su comparación frente a la mittelbare Drittwirkung de Alemania. (RI §425168)  


Effects of fundamental rights in relationships between particulars. special reference to the typology of cases in the state action of the United States and its comparison against the mittelbare Drittwirkung of Germany - Alexander Pascual Espinoza Rausseo y Jhenny F. Rivas Alberti

Nuestro estudio tiene por objeto determinar si la teoría de la acción estatal constituye una institución comparable en su contenido y alcance con respecto a la teoría alemana de los efectos mediatos frente a terceros de los derechos fundamentales o, si por el contrario se trata de instituciones de distinta naturaleza. En oposición a la estructura horizontal de la mittelbare Drittwirkung, la state action es valorada como el paradigma del enfoque polar, estrictamente “vertical" de los derechos constitucionales, pero también como un considerable vacío en la protección constitucional. Se afirma que, entre ambas existirían diferencias sustanciales de teoría y enfoque que producirían resultados muy diferentes. Sostendremos que la mittelbare Drittwirkung no es aplicable a los casos en los cuales se produce una afectación del derecho de propiedad, los cuales constituyen el ámbito en el que ha tenido su origen y desarrollo la doctrina de la state action, por lo que no sería posible una comparación directa entre ambas.

Our study aims to determine whether the theory of state action constitutes an institution comparable in its content and scope with respect to the German theory of the mediate effects on third parties of fundamental rights or, if on the contrary they are institutions of a different nature. In opposition to the horizontal structure of the mittelbare Drittwirkung, state action is valued as the paradigm of the polar, strictly "vertical" approach to constitutional rights, but also as a considerable gap in constitutional protection. It is stated that, between the two, there would be substantial differences in theory and approach that would produce very different results. We will hold that the mittelbare Drittwirkung is not applicable to cases in which there is an impairment of property rights, which constitute the area in which the doctrine of state action has had its origin and development, so a direct comparison would not be possible between both.
