The constitutional subject. Between the abstraction of citizenship and the exclusion of bodies ‘other’ - Luisa Winter Pereira

¿Cómo se construye el sujeto del constitucionalismo? Esta es la pregunta sobre la que se reflexiona en el presente artículo a través de las dicotomías abstracción vs. materialidad, sujeto/ciudadanía vs. corporalidad, universalidad vs. situacionalidad. Retrotrayéndonos a cómo se ha construido el sujeto moderno occidental a través del llamado momento cartesiano, se estudian dos relatos que funcionan por medio de una lógica de inclusión-exclusión: las generaciones de derechos humanos y las olas del feminismo. Analizando cómo se excluyen determinadas subjetividades de dichos relatos, el artículo finaliza con dos ejemplos concretos sobre cómo funciona dicha lógica de inclusión-exclusión en la configuración del sujeto de derecho y la ciudadanía: mujeres lesbianas y personas intersexuales.

How is the subject of constitutionalism constructed? This is the question that this article reflects on through the dichotomies of abstraction vs. materiality, subject/citizenship vs. body, universality vs. situationality. Looking back at how the modern Western subject has been constructed through the so-called Cartesian moment, two narratives are studied that function by means of a logic of inclusion-exclusion: the generations of human rights and the waves of feminism. Analysing how certain subjectivities are excluded from these narratives, the article ends with two concrete examples of how this logic of inclusion-exclusion functions in the configuration of the subject of law and citizenship: lesbian women and intersex people.
