En las décadas centrales del siglo XX, durante la expansión del totalitarismo, la literatura europea dirigió su análisis hacia el Estado romano, y las soluciones políticas, jurídicas e institucionales de su sistema imperial. La reflexión, con su renovado tratamiento del “mito de Roma”, da lugar a una perspectiva del Estado de Derecho, y de la universalidad de su proyecto de civilización, que habría de corresponderse con la refundación del Estado de Derecho contemporáneo, y de su sistema constitucional, democrático y parlamentario.
