El principio pro personae como criterio hermenéutico del TJUE frente a situaciones de vulnerabilidad socio-digital. (RI §424773)  


The pro personae principle as the CJEU’s interpretative criteria vis-à-vis situations of socio-digital vulnerability - Mónica Martínez López-Sáez

El principio pro personae se concibe como principio rector en el caso de conflictos normativos y conflictos interpretativos en materia de derechos fundamentales, ordenando una prevalencia de la norma o interpretación más favorable. Mutatis mutandis, rige asimismo como criterio que ordena una interpretación restrictiva cuando de limitaciones en los derechos fundamentales se trata. Este, como parte de la perspectiva basada en los derechos humanos, ha sido principio rector en el sistema europeo de protección de los derechos y el TJUE ha hecho uso de él en su exégesis jurisprudencial, en general, y, de manera especial, al interpretar el derecho fundamental a la protección de datos (y derechos análogos) bajo la expresión indeterminada y ambigua de “la situación particular” del interesado del tratamiento. El presente artículo desarrolla este principio, en el marco de la constitucionalización de la UE, y lo expone como canon hermenéutico frente a situaciones de vulnerabilidad socio-digital a la luz de la normativa y jurisprudencia europea en materia de protección de datos.

I. CONSIDERACIONES PREVIAS Y PREMISAS DE PARTIDA: 1. Sobre los riesgos del (ab)uso del tratamiento de datos de carácter personal. 2. Sobre el fenómeno de la vulnerabilidad socio-digital.- II. EL PAPEL DEL TJUE EN EL SISTEMA EUROPEO DE PROTECCIÓN DE LOS DERECHOS FUNDAMENTALES (EMERGENTES): 1. La dignidad, los derechos fundamentales y la protección de datos en el marco del constitucionalismo europeo. 2. El TJUE como órgano principal de control hermenéutico y de constitucionalidad de la Constitución material europea.- III. LA INTERPRETACIÓN IUSFUNDAMENTAL Y EL PRINCIPIO PRO PERSONAE COMO CRITERIO HERMENÉUTICO: 1. La interpretación jurídica y su especificidad en relación con los derechos fundamentales. 2. El principio pro personae como criterio vanguardista en la protección y promoción de los derechos fundamentales.- IV. LA PRAXIS HERMENÉUTICA DEL TJUE ANTE SITUACIONES DE VULNERABILIDAD EN MATERIA DE PROTECCIÓN DE DATOS: 1. La noción de vulnerabilidad y el principio pro personae en la jurisprudencia del TJUE. 2. El principio pro personae en materia de protección de datos. 2.1. El cambio paulatino de mentalidad hermenéutica a favor de la persona afectada en casos digitales. 2.2. La “situación particular” del interesado del tratamiento como criterio clave del canon pro personae en materia de protección de datos. V. CONCLUSIÓN.

The pro personae principle is conceived as a guiding principle in cases of normative and interpretative conflict in fundamental rights matters, establishing a prevalence of the most favorable norm or interpretation for the individual; mutatis mutandis, it also governs as a criterion that mandates a restrictive interpretation when it comes to fundamental rights’ limitations. As part of the human rights-based perspective, this principle has guided the EU fundamental rights system. The CJEU has made use of this principle in its judicial practice and interpretation when applying EU Law, in general, and, when interpreting the fundamental right to data protection (and other related rights) in particular. It has done so through the use of the indeterminate and ambiguous expression of the data subject’s “particular situation”. This article develops this principle, within the framework of the constitutionalization of EU, and defends its necessary use as a hermeneutic canon in the light of data protection norms and case law vis-à-vis socio-digital vulnerability.

THE ROLE OF THE CJEU IN THE EUROPEAN SYSTEM OF PROTECTION OF (EMERGING) FUNDAMENTAL RIGHTS: 1. Dignity, fundamental rights and data protection in the framework of European constitutionalism. 2. The CJEU as the body in charge of the EU material constitution’s hermeneutic and constitutionality control.- III. LEGAL INTERPRETATION AND THE PRO PERSONAE PRINCIPLE AS AN HERMENEUTIC CRITERION: 1. Legal interpretation and its fundamental rights specificities. 2. The pro personae principle as an avant-garde criterion in the protection and promotion of fundamental rights.- IV. THE INTERPRETATIVE PRACTICE OF THE CJEU OF VULNERABLE SITUATIONS IN THE FIELD OF DATA PROTECTION: 1. The notion of vulnerability and the pro personae principle in the CJEU’s case law. 2. The pro personae principle in data protection matters. 2.1. Gradual shift in interpretation in favor of the affected person in digital scenarios. 2.2. The ‘particular situation’ of the data subject as a key criterion of the pro personae canon in data protection matters. V. CONCLUSIONS.
