Presumption of innocence and judicial impartiality: keys to their protection in the scenario of parallel trials - Cristina San Miguel Caso

El ejercicio de las libertades informativas en la transmisión y difusión de la información relativa a los asuntos judiciales puede quebrantar, eventualmente, los derechos y garantías de las partes a través de los denominados juicios paralelos. A pesar de tratarse de un fenómeno de carácter extrajudicial su incidencia, desde el punto de vista procesal, invita a reflexionar de forma crítica sobre la protección y salvaguarda que nuestro ordenamiento jurídico confiere, en la actualidad, tanto a la presunción de inocencia como a la imparcialidad judicial en el escenario de los juicios paralelos. Con esta finalidad, el trabajo tiene por objeto analizar los aspectos más controvertidos de ambas garantías, llevando a cabo diversas propuestas enfocadas a lograr una protección más garantista y eficaz.

The exercise of the informative freedom of information in the transmission and dissemination of information related to judicial matters may, eventually, infringe the rights and guarantees of the parties through the so-called parallel trials. Despite being an extrajudicial phenomenon, its incidence, from the procedural point of view, invites to reflect critically on the protection and safeguard that our legal system confers, at present, on both the presumption of innocence and the judicial impartiality in the scenario of parallel trials. With this purpose, the work aims to analyze the most controversial aspects of both guarantees, carrying out various proposals focused on achieving a more guaranteed and effective protection.
