El trabajo y la protección de seguridad social a bordo de los buques de pesca en el acuerdo de comercio y cooperación entre la Unión Europea y el Reino Unido de Gran Bretaña e Irlanda del Norte. (RI §424419)

Este trabajo analiza el Acuerdo de Comercio y Cooperación entre la Unión Europea y el Reino Unido desde el punto de vista de los derechos laborales y de seguridad social de las personas que trabajan a bordo de los buques de pesca. Sorprendentemente, se trata de un Acuerdo que no dice nada sobre la regulación laboral del trabajo a bordo de estos buques, de modo que hay que estar al Derecho interno de los Estados aquí implicados y en el que está muy presente el Convenio número 188, sobre el Trabajo en la Pesca, de la Organización Internacional del Trabajo (aunque hay grandes diferencias entre lo realizado por el Reino Unido, fuera ya de la Unión Europea, y por España, siempre como Estado miembro de la Unión Europea). Por el contrario, el Acuerdo sí contiene reglas específicas sobre la seguridad social que debe aplicarse a bordo de estos buques de pesca.

I. UNA APROXIMACIÓN FORMAL A UN ACUERDO DE COMERCIO Y COOPERACIÓN, A MODO DE INTRODUCCIÓN. 1. Un acuerdo publicado dos veces en el Diario Oficial de la Unión Europea. 2. Un contenido ciertamente voluminoso, pero sin índice. 3. La pesca y la seguridad social entre las materias que son objeto de regulación. II. LA PRESENCIA TRANSVERSAL DEL BUQUE. 1. En lo que tiene que ver con un transporte marítimo competitivo pero respetuoso con los derechos laborales y de seguridad social. 2. En lo que tiene que ver con las actividades de exploración, explotación, conservación y gestión sostenible de los recursos biológicos marinos y la acuicultura. 3. En lo que tiene que ver con la protección de seguridad social. III.EL SILENCIO SOBRE LA REGULACIÓN DEL TRABAJO A BORDO DE LOS BUQUES DE PESCA. 1.El Convenio número 188, sobre el Trabajo en la Pesca (2007), como factor de aproximación. 2. La incorporación del Convenio número 188, sobre el Trabajo en la Pesca (2007), al Derecho de la Unión Europea. 3. This paper analyzes the EU-UK Trade and Cooperation Agreement from the point of view of the labor and social security rights of the people who work on board fishing vessels. Surprisingly, this Agreement does not say anything about the labor regulation of work on board these fishing vessels, so it is necessary to apply the internal legislation of the States involved here and in which Work in Fishing Convention (ILO 188) is very present (although there are big differences between what has been done by the United Kingdom, outside the European Union, and by Spain, as a Member State of the European Union). On the contrary, the Agreement contains specific rules on social security that must be applied on board these fishing vessels.

I. A FORMAL APPROACH TO A TRADE AND COOPERATION AGREEMENT, AS AN INTRODUCTION. 1. An agreement that has been published twice in the Official Journal of the European Union. 2. Regarding maritime transport, within the framework of a competitive trade that must be respectful of the labor and social security rights. 2. Regarding the activities of exploration, exploitation, conservation and sustainable management of marine biological resources and aquaculture. 3. Regarding social security protection. III.
