Control and inspection by Spain of working conditions in the fisheries sector in spanish vessels and foreign vessels - Arántzazu Vicente Palacio

España todavía no ha ratificado el Convenio nº 188 sobre el trabajo en la pesca (2007). El RD 618/2020, de 30 de junio supone la incorporación al ordenamiento español de la Directiva 2017/159/ UE de 19 de diciembre de 2016, por la que se aplica el Acuerdo relativo a la aplicación del Convenio sobre el trabajo en la pesca de 2007 de la Organización Internacional del Trabajo, celebrado el 21 de mayo de 2012 entre representantes de los trabajadores y empresarios en el ámbito pesquero. Dado su origen, la normativa comunitaria no regula las obligaciones de inspección y certificación previstas en el Convenio nº 188. Tampoco se ha aprobado la norma española que regule este aspecto fundamental que afecta a España como Estado de Pabellón y como Estado gestor del Puerto. El trabajo aquí presentado examina la normativa que desarrolla el sistema de control e inspección de la Política Pesquera Común y la lucha contra Pesca ilegal, no declarada y no reglamentada (pesca INDNR) en ambos niveles normativos para valorar la conveniencia o no de incluir en este sistema el control de las condiciones de trabajo en la pesca.

Spain has not yet ratified ILO Work in Fishing Convention, 2007 (No. 188). RD 618/2020, of June 30, introduce into Spanish legislation Directive 2017/159/ EU of December 19, 2016, which applies the Agreement on the application of the ILO Convention on Work in Fishing (2007) held on May 21, 2012 between European representatives of workers and employers in the fisheries field. Given its origin, the European Union regulation does not regulate the inspection and certification obligations provided for in Convention No. 188. Nor Spain had adopted any national regulation in this respect done. This paper analyses the regulations that develop the control and inspection system of the Common Fisheries Policy and the fight against illegal, unreported and unregulated fishing (IUU fishing) at both regulatory levels to assess whether or not to include in this system control of working conditions in fishing.
