La finalización de la dictadura marco un periodo de cambio en todos los sectores sociales, incluido el militar. Fueron muchos los cambios producidos en la Legislación militar tras la aprobación de la CE, en un período ya de por si complejo, denominado Transición, durante el cual las viejas instituciones hubieran debido adaptarse a los principios del nuevo Estado Social y democrático de Derecho. Desgraciadamente, al menos inicialmente, en el ámbito militar, no fue así. El mantenimiento de los fueros adquiridos a lo largo de todo el siglo XX lastró, durante años, el necesario proceso de modernización y adaptación a la nueva realidad constitucional. Este trabajo pretende mostrar cuales fueron los momentos y las reformas decisivas en ese largo proceso de adaptación de la Justicia militar a esta nueva realidad.

The end of the dictatorship marked the beginning of a transformation period in all social segments, including the military. There were many changes in the military legislation during this convoluted period, named the Transition, after the passing of the Spanish Constitution, which involved the modification of old institutions to adjust to the principles of the new social and democratic State subject to the rule of law. Unfortunately, reforms in the military field were slow and arduous. Special privileges named “fueros” were kept during most of the XX century, which in turn hindered the process of modernization and adaptation to the new constitutional order. This paper is intended to determine the key moments and reforms during the adaptation of the military jurisdiction to this new reality.
