Procedure before International Courts and COVID-19: the use of information and communication technologies - Ana Gascón Marcén

En este trabajo, se expondrá la reacción de los tribunales internacionales a los problemas planteados por la COVID-19 para su funcionamiento. En particular se estudiará cómo han recurrido al uso de las tecnologías de la información y la comunicación para poder seguir cumpliendo con su mandato y administrando justicia a pesar de las dificultades, optando, por ejemplo, por la celebración de audiencias con participación remota. Se analizarán en concreto las adaptaciones del Tribunal Europeo de Derechos Humanos, el Tribunal de Justicia de la Unión Europea, la Corte Penal Internacional y la Corte Internacional de Justicia, con menciones a lo hecho por otros tribunales internacionales. Se compararán las respuestas dadas por los mismos para poder deducir ciertas tendencias.

In this paper, the reaction of international courts to the problems posed by COVID-19 for its operation will be exposed. In particular, it will study how they have resorted to the use of information and communication technologies in order to continue fulfilling their mandate and administering justice despite the difficulties, opting, for example, for holding hearings with remote participation. The adaptations of the European Court of Human Rights, the Court of Justice of the European Union, the International Criminal Court and the International Court of Justice will be specifically analyzed, with references to what has been done by other international courts. The answers given by them will be compared in order to deduce certain trends.
