The enforcement powers of the Constitutional Court - Walter Reifarth Muñoz

Este trabajo tiene por objeto el análisis crítico de los poderes de ejecución del Tribunal Constitucional a partir de la Ley Orgánica 15/2015, de 16 de octubre. En concreto, se partirá de la efectividad de las resoluciones constitucionales como pretendida base de una reforma que ha ampliado las facultades de que ya disponía el Tribunal y ha introducido importantes modificaciones en esta materia, como la posibilidad de suspender a autoridades y funcionarios públicos, de solicitar del Gobierno de la Nación la ejecución sustitutoria, de deducir el testimonio de particulares para exigir responsabilidad penal y de imponer medidas inaudita parte en casos de especial trascendencia constitucional.

La necesidad, oportunidad y tramitación de la reforma. 2. La notificación personal y el auxilio judicial. 3. Las resoluciones constitucionales como «título ejecutivo» y el incidente de ejecución. 4. Las concretas potestades del artículo 92 LOTC: 4.1. La posibilidad de imponer multas coercitivas. 4.2. La suspensión de autoridades y funcionarios públicos. 4.3. La ejecución sustitutoria. 4.4. La deducción del testimonio para exigir responsabilidad penal. 4.5. La facultad de imponer medidas inaudita parte. 5. La aplicación supletoria de la LJCA. IV. CONCLUSIONES. BIBLIOGRAFÍA.

This paper aims to critically analyze the enforcement powers of the Constitutional Court following the Organic Act 15/2015, of 16th October. In particular, our starting point is the effectiveness of constitutional decisions as alleged basis of the aforementioned reform, which has extended the powers of the Constitutional Court and introduced new ones, such as the possibility of suspending authorities and public servants, calling for the enforcement by the national government, attesting the criminal liability of individuals or imposing enforcement measures inaudita parte in situations involving special constitutional importance.
