Collective claims, serial claims and lead claim. Judges and Council of the judiciary face to mass civil litigation - Manuel Ortells Ramos

La actitud de la judicatura ante los litigios civiles en masa ha determinado una peculiar evolución de los instrumentos adecuados para tratarlos de modo eficiente. El régimen de la LEC no ha sido (tal vez porque no ha podido ser) aplicado para satisfacer suficientemente las necesidades de protección de una pluralidad de derechos individuales lesionados por una causa común. Una avalancha de demandas individuales sobre cláusulas abusivas en contratos de préstamo con garantía hipotecaria amenazó la capacidad de respuesta del sistema judicial. El CGPJ optó por proteger al conjunto del sistema con el cortafuego de concentrar la competencia sobre tales demandas en un solo juzgado por provincia. Estos juzgados han estimado más del noventa por cien de tales demandas. Esta constatación ha sugerido que es conveniente establecer una técnica que elimine o reduzca la carga de trabajo y los costes de la tramitación separada de litigios cuya resolución acaba por ser igual en un porcentaje tan elevado. Con este fin, el CGPJ ha propuesto regular el proceso testigo en materia civil y modificar la regulación de la extensión de efectos de determinadas sentencias. En este trabajo se analizan esas propuestas.

The attitude of the judges and the Council of the Judiciary toward mass civil litigation has determined a peculiar evolution of the appropriate instruments to deal with it efficiently. The rules about the collective judicial protection of the Spanish Civil Procedure Act have not been applied -maybe because they could not be applied- in a way to sufficiently satisfy the needs of judicial protection, especially in cases of a plurality of individual rights damaged by a common cause. An avalanche of individual lawsuits over abusive clauses in mortgage contracts threatened the responsiveness of the judicial system. The Council of the Judiciary chose to protect this system with the firewall of concentrating jurisdiction over such lawsuits in a single court per province. More than a ninety percent of such claims were upheld by those courts. This finding has suggested that it would be appropriate to establish a technique that eliminates or reduces the workload and costs of the separate processing of disputes whose resolution ends up being the same in such a high percentage. To achieve this aim, the Council of the Judiciary has proposed a regulation of the lead case in civil matters and also a reform of the rules that allow to extent the effects of certain sentences beyond the specific case they have decided. This paper analyses those proposals.
