The jurisprudential consolidation of the new paradigm of urban planning through the regime of urban actions on urban land: renovation and endowment actions - Juan José Santana Rodríguez y José Juan Suay Rincón

El urbanismo sitúa en la actualidad el foco de su atención en la “ciudad existente” y para facilitar el desarrollo de las actuaciones urbanísticas en el mismo, al amparo de la normativa actualmente en vigor, la jurisprudencia ha propiciado un cambio en su doctrina que abre ahora el paso a la exigibilidad de nuevas cargas en suelo urbano. Se examinan en este trabajo los avances de este giro jurisprudencial y también sus eventuales carencias.

Urban planning currently places the focus on the “existing city”, and to facilitate the development of urban activities in it, under the regulations currently in force, the jurisprudence has propitiated a change in its doctrine that now opens the way to the enforceability of new burdens in urban ground. The advances of this jurisprudential turn, as well as their eventual shortcomings, are examined in this paper.
