The selection procedure of european judges in Spain: a weak decree, but a welcome step in the right direction - Juan Santos Vara

Por primera vez, España se ha dotado de una norma general que regula de forma comprehensiva el procedimiento de selección de candidaturas propuestas por nuestro país en la designación de miembros del TJUE y del TEDH. Se trata de una norma oportuna y necesaria con el objetivo de dotar una mayor transparencia y evitar arbitrariedad en el proceso de selección de candidatos que presente España para el ejercicio de responsabilidades muy importantes en las más altas instancias jurisdiccionales europeas. Es un paso importante en la buena dirección. Sin embargo, el análisis del contenido del nuevo marco jurídico nos muestra que los ambiciosos objetivos planteados en la exposición de motivos del Decreto no se han logrado plenamente.

For the first time, Spain has adopted a general law establishing a comprenhensive procedure for the selection of candidatures for the appointment of judges to the ECJ and the ECHR. It is a timely and needed norm aiming to improve the transparency and avoid arbitrariness in the procedure for the selection of candidatures to the most relevant European Courts. It is a welcome step in the right direction. However, the analysis of the new legal framework shows clearly that the ambitious objectives laid down in the preamble of the Decree are not fully reached.
