The continuity of the model andalusí: the ordinances of the waters of Granada of 1538 - Yolanda Quesada Morillas

El presente trabajo trata de poner de manifiesto la necesidad e importancia del agua, medio esencial de vida, desde el punto de vista histórico-jurídico. Para ello nos ceñimos a un ámbito geográfico determinado: el sureste peninsular y, concretamente, el antiguo Reino Nazarita de Granada. Cronológicamente abarcamos desde las primeras fuentes jurídicas que así lo atestiguan –época romana-visigoda– e incidiendo en la musulmana por la trascendencia que la organización y regulación del agua tuvo sobre la ulterior Granada cristiana. Las Ordenanzas de las Aguas de Granada de 1538 es nuestro principal objeto de análisis por su relevancia, aplicación y vigencia hasta el siglo XIX. Por último, analizamos el órgano jurisdiccional competente que conoció de los conflictos suscitados en torno a las aguas en esta demarcación: el Juzgado Privilegiado de las Aguas de Granada.

Vigencia de las Ordenanzas de las Aguas. III. EL ÓRGANO JURISDICCIONAL: EL JUZGADO PRIVILEGIADO DE LAS AGUAS DE GRANADA. IV. CONCLUSIONES.

This work has the aim to show the need and importance of water, an essential mean of life, seen from the historical-legal point of view. For this we stick to a specific geographical area: the southeast of the peninsula and specifically the old Nasrid Kingdom of Granada. Chronologically we cover from the first legal sources that testify this –Roman-Visigothic times– highlighting the Muslim period due to the importance that the organization and regulation of water had on the subsequent Christian Granada. The Water Ordinance of Granada of 1538 is our main object of analysis due to its relevance, application and validity until the 19th century. Finally, we analyze the competent court that solved the disputes that the waters in this area caused: The Privileged Court of the Waters of Granada.
