Comparative study regarding European Union practice in disputed territories - Carolina Jiménez Sánchez

El presente artículo se centra en examinar las implicaciones actuales de las normas aplicables y la práctica desarrollada por la Unión Europea con respecto a territorios cuya soberanía se encuentra disputada. Será objeto de análisis comparado su especial relación con la debida protección de los Derechos Humanos de estas poblaciones, la aplicación del Derecho Internacional Humanitario y su polémico encaje con las relaciones comerciales de la Unión Europa. En concreto, se estudiarán los casos de Crimea, Palestina, el Sáhara Occidental, Kosovo y Gibraltar.

This article focuses on examining the current implications of the applicable rules and the practice developed by the European Union with respect to territories whose sovereignty is disputed. Its special relationship with the due protection of the Human Rights of these populations and their controversial alignment with the commercial relations of the European Union will be addressed. In particular, the cases of Crimea, Palestine, Western Sahara, Kosovo and Gibraltar will be analyzed.
