(RI §423150)

The concept of teleworking and the regime of reversibility. Two of the several questionable aspects of the recent Argentine Law N.º 27,555. Suscints comparison with the spanish regime - Juan Ángel Confalonieri

I. Introducción.- II.

The non-existence of a legal body on teleworking in Argentina, and the regulations dictated as a result of COVID-19, were decisive for the government to decide to develop a project that, finally, ended up being law on July 31, 2020 (No. 27.555, promulgated by decree 673/2020, BO, August 14, 2020). It will enter into force once 90 days have elapsed from the end of the "social, preventive and compulsory isolation", imposed by the Decree of Necessity and Urgency (DNU) 297/2020. A law that, although it was approved in the Chamber of Deputies by a wide margin (214 votes in favor, 29 abstentions and 1 negative vote), not only that the same did not happen in the Chamber of Senators (40 votes in favor and 30 negatives), but has deserved severe criticism from the business community and a part of the academic doctrine.

I. Introduction.- II. The legal regime of the teleworking contract in Argentina.- III. The aspects to compare of the Spanish and Argentine regimes.- 3.1. The structural features of the telework concept.- 3.2. The severe deterioration of the volitional element in Law 27.555.

Keywords: Remote work; work at home; teleworking; Spain; RDL 28/2020; Argentina; Law 27.555.;
