Origin and evolution of the electricity legal framework in Spain - Antonio Jesús Sánchez Rodríguez

En este artículo presentamos una visión de cómo se ha regulado el servicio de suministro eléctrico en nuestro ordenamiento jurídico, haciendo hincapié en algunos aspectos más importantes que giran en torno al bien jurídico central: garantía de suministro eléctrico. La normativa ha ido desde un régimen jurídico de semimonopolio a un régimen jurídico liberalizador en las actividades de generación y comercialización, quedando las actividades de red (transporte y distribución de electricidad) bajo un régimen de control especial por las Administraciones públicas, que configuran tanto el régimen de uso de las redes como el régimen económico aplicable.

In this paper we present a vision of how the electricity supply service has been regulated in our legal system, emphasizing the more important aspects that revolve around the very important legal interest: guarantee of electricity supply. The regulations have gone from a semi-monopoly legal regime to a liberalizing legal regime in production of electricity and commercialization activities, having the network activities (electricity transport and distribution of electricity) under a special control regime established and controlled by the public administration, which make up both the network use regime as the economic regime applicable to the owners of the network.
