Rule of law, infringement procedure and the rise of authoritarianism in Hungary. Reflections on the CJEU Judgment of the 18th june 2020 on the NGOS’ transparency Law - Marta Sosa Navarro

El presente comentario analiza la sentencia dictada por el TJUE en el asunto C-78/18 que enfrenta a la Comisión Europea contra Hungría con motivo de la adopción de la Ley de Transparencia, que impone obligaciones de publicidad, registro y declaración a las organizaciones no gubernamentales que reciban fondos extranjeros. La sentencia, dictada en el marco de un procedimiento por incumplimiento interpuesto por la Comisión Europea, establece que Hungría ha incurrido en un incumplimiento de las obligaciones que le incumben en virtud de los Tratados aplicables mediante la violación de los artículos 63 TFUE y 12, 7 y 8 de la Carta de Derechos Fundamentales de la UE. Este trabajo realiza un análisis conjunto de los argumentos jurídicos de la Gran Sala, las conclusiones del Abogado General y los estudios doctrinales sobre los temas tratados, y examina las opciones de las que dispone la Unión para frenar el auge del autoritarismo y la vulneración de los valores comunitarios por parte de sus Estados miembros.

This commentary analyses the judgment issued by the CJEU in the case C-78/18 that confronts the European Commission against Hungary on the occasion of the adoption of the Transparency Law or Lex NGO, which imposes obligations of publicity, registration and declaration to the non-governmental organizations that receive foreign funds. The judgment, issued within the framework of an infringement procedure brought by the European Commission, establishes that Hungary has incurred in a breach of its obligations under the applicable Treaties by violating articles 63 TFEU and 12, 7 and 8 of the Charter of Fundamental Rights of the EU. This work carries out a cross-examination of the legal arguments of the Grand Chamber, the conclusions of the Advocate General and the scholarly writings on the issues at stake, and examines the options available to the Union to curb the rise of authoritarianism and the persistent breach of its values by its Member States.
