Algunas reflexiones sobre la nulidad diferida al hilo de las sentencias del TC español. (RI §423021)  


Some reflections on the deferred annulment by the judgments of the spanish Constitutional Court - Paloma Requejo Rodríguez

No es fácil compatibilizar las consecuencias de la supremacía constitucional y la continuidad del ordenamiento para evitar perjuicios y salvaguardar en último término bienes y valores constitucionales, como el interés general. Ello obliga al Tribunal Constitucional a abandonar en ocasiones la “zona de confort” de las sentencias estimatorias o desestimatorias y explorar nuevos territorios, como el de las sentencias de nulidad diferida, no exentos de peligro, en tanto su papel y el del legislador pueden verse alterados. El trabajo se centra en esta categoría, diferenciándola de otras afines, y defiende un uso excepcional de la misma, que requiere una motivación reforzada, así como una serie de garantías, que no siempre se cumplen.

It’s not easy to balance the consequences of constitutional supremacy and the continuity of the legal system in order to avoid harming colliding interests and ultimately protect constitutional values, such as the common wealth. With this balancing purpose the Constitutional Court sometimes abandons its “comfort zone” and explores new territories by sometimes deferring the annulment of a legal provision to a time after the judgment is adopted. Doing this is not riskless, as it may alter its role and the role of the legislator. This commentary focuses on the category of deferred annulment, differentiating it from other related categories, and arguing for a restricted use of it, and, if used, for a reinforced motivation and respect for some safeguards, which are not always met.
