El equipaje de los pasajeros en el transporte aéreo: la jurisprudencia sobre el equipaje de mano. (RI §422746)  

El análisis jurisprudencial de reclamaciones de los pasajeros en el transporte aéreo sobre el equipaje que se transporta en cabina permite avanzar en la protección del consumidor. Examinamos la sentencia del Juzgado mercantil nº 13 de Madrid, de 24 de octubre de 2019, en relación con la jurisprudencia del Tribunal de Justicia de la UE, para centrarnos en la delimitación del principio de libertad de precios y las cláusulas contractuales que incrementan el precio de forma obligatoria, buscando el punto de equilibrio entre las posiciones de las partes. La fundamental incidencia de este sector en el turismo requiere un exhaustivo esfuerzo de protección del cliente por parte del legislador, nacional y europeo, cuando regula la responsabilidad del transportista respecto al pasajero y su equipaje, tanto desde las normas del derecho de consumo como desde el derecho de la competencia, en especial en situaciones de crisis tan graves como la generada por el estado de alarma.

Case law analysis of air passenger complaints about baggage carried in the cabin allows progress to be made in consumer protection. We examine the judgement of the Commercial Court nº 13 of Madrid of 24 October 2019, in relation to the case law of the EU Court of Justice, to focus on the delimitation of the principle of freedom of price and the contractual clauses that increase the price on a mandatory basis, seeking the point of balance between the positions of the parties. The fundamental impact of this sector on tourism requires an exhaustive effort to protect the customer by the legislator, both national and European, when regulating the liability of the carrier with respect to the passenger and his luggage, both from the rules of consumer law and from the law of competition, especially in crisis situations as serious as that generated by the state of alarm.
