La crisis del coronavirus ha traído consigo el ejercicio de los poderes de necesidad a los tres niveles administrativos territoriales (estatal, autonómico y local). En este contexto, la declaración del estado de alarma por el Estado y el uso del Derecho legal de necesidad por las Comunidades Autónomas y las Entidades Locales, han puesto de manifiesto la necesidad de actualización del primero, así como la inmadurez del segundo. El presente trabajo tiene por objeto realizar un acercamiento teórico y práctico a tales problemas, proponiendo, en su caso, algunas soluciones pro futuro.

As a result of the COVID-19 outbreak, Spain has been forced to wield its emergency powers at its three levels of territorial administration (State, Regions and municipalities). In this context, the declaration of state of alarm by the spanish Goverment, and the use of the legal emergency powers by the Spanish Regions and local entities, has highlighted the convenience of overhauling the former, and -at the same time- has stressed the immaturity of the latter. This paper addresses the referred matters from both theorical and practical perspectives, attempting as well to suggest certain courses of action for the refurbishment of this sector of the Spanish legal system.
